Registration of a player under written contract (2023/24)

1. DEFINITIONS

1.1 “Parent” means a parent or legal guardian who will be responsible for the payment of fees and who

is the contracting party to this agreement.

1.2 “Worksop Town Academy” means Evolution Soccer Ltd., with whom you have entered into

this agreement.

1.3 “Season” means the duration of the season you have been invited to attend, which in this case runs

from 01.08.23 to 31.07.24.

1.4 “Fee” means the monetary cost per season as specified in 3.1.

1.5 “Coach” means the individual(s), employed by Evolution Soccer Ltd. Whilst every effort will be taken

to maintain the consistency of the Coaches during the season, Worksop Town Academy retain the right

to change the coaching staff where necessary.

1.6 “Venues” or “Premises” means the premises where the season’s training sessions take place

unless stated otherwise. The address of the Premises is Worksop Town FC, Babbage Way,

Worksop, S80 1UJ

1.7 “Player” means the child attending the Season, whose details are specified by the Parent or

carer on the registration form.

1.8 When we use the words "writing" or "written" in these terms, this includes email.

1.9 “Terms” means the terms and conditions set out in this document and any special terms and

conditions agreed in writing by Worksop Town Academy and the parent.

2. ACCEPTANCE OF TERMS AND CONDITIONS

2.1 All agreements relating to the Season provided by Worksop Town Academy to the child are

subject to these terms to the exclusion of all other terms and conditions.

2.2 No changes or addition to the terms shall be binding unless agreed in writing by Worksop Town

Academy and the parent.

2.3 The terms shall be deemed to have been accepted by the parent upon payment of your initial fee

as outlined in 3.1a or 3.1b taken on or before 01.08.23 by or on behalf of the Parent.

3. FEES AND PAYMENTS

3.1 The parent shall pay the Season fees as 12 monthly installments of £68.99, or pro-rata from the

agreed start date for those joining part-way through the season.

3.2 Fees shall be paid via direct debit.

3.2. The player’s attendance to the season will start on your joining date, or on 01.08.23 whereby you

will enter into a 12-month contract with Evolution Soccer Limited as an Initial Fixed Term. You cannot

cancel your contract within the initial Fixed Term, which is 12-months from 1st August 2023, unless

clauses 6 and/or 7 below applies. If you do cancel your contract in the Initial Fixed Term you will breach

the contract between us.

3.3 The contract will continue until the end of the initial fixed term unless it is ended in accordance with

clauses 6 and/or 7 below and/or by written agreement between the Parent and Worksop Town

Academy.

3.4 At the end of the Initial Fixed Term, renewal of the contract for the subsequent season will be

by invitation only and at the discretion of Worksop Town Academy.

3.3 The fee is non-refundable under any circumstances except with the prior written agreement of

Worksop Town Academy and/or if clauses 6 and/or 7 below apply.

3.4 Your season fees will be payable for the duration of the season, regardless of whether or how much

you make use of the training/competition.

3.5 Any changes in the rate of VAT will be passed on. If the rate of VAT changes whilst you are a

member, we will adjust the rate of VAT that you pay, and this will result in a change to your membership

fees.

3.6 We can change your fees at any time for any reason stated in clauses 9.3 or 9.4 below by giving

you at least 30 days' notice in writing. If you do not want to pay the changed fee, you can cancel your

contract by giving us written notice to cancel at any time before the change in fee comes into force. If

you do give us notice to cancel you will continue to be charged the previous fee until that notice of

cancellation takes effect. If you are still in your Initial Fixed Term, any notice of cancellation you give

following a proposed increase in membership fees will not take effect until the end of your Initial Fixed

Term, and we will honour the previous fees until the end of your Initial Fixed Term.

3.7 Your membership fees will be payable by either direct debit or via a valid debit card subscription. If

a payment has been cancelled or has failed, you will be charged a fee of £25.00 for every and all

missed payments, to cover our administration costs.

3.8 Any missed or late payments will result in the player not being permitted to participate again

at either training or competition until all outstanding fees have been cleared.

3.9 For any unpaid fees passed 31 days, with no written communication between us coming to an

agreement regarding fees, you will be in breach of our contract as per 3.2, and we will pass this on to a

third-party debt collection agency and the player will be released from the academy.

4. OUR OBLIGATIONS

4.1 Worksop Town Academy agrees to the following:

4.1.a) deliver 2 x training sessions per week to all academy age groups on the days outlined in

the Timetable provided in Section 10 with the exception of:

4.1.a.i) if there is a National Bank Holiday on the same day that your training is scheduled

4.1.a.ii) the period from 22.12.23 to 02.01.24 named “The Christmas Period”

4.1.a.iii) if classes are cancelled due to an “Act of God” (extreme weather conditions,

earthquakes etc.) strikes, terrorist activity or where local authorities/public guidance

suspend for health or other reasons. No refunds will be provided for any of the reasons in

this item (4.1.a.iii)

4.1.a.iv) if a session is cancelled due to staff illness or other absence, we will provide a

refund for the amount of £4.00 for every session missed by way of a discount from the

following month’s fees.

4.1.a.v) Worksop Town FC first team take priority over use of the pitch and should there be

any fixture or event involving the first team then any and all sessions will be cancelled on

this specific date only. No refund will be offered for such a cancelation however an

alternative session will be provided matching or exceeding the missing training hours

before the end of the season

4.1.c) provide at least two in depth player performance reviews per Season

4.1.d) Organise & arrange all academy fixtures and tournament entry

(4.1.d.i) For U8-U12: these will be entered into a Foundation Phase games programme

organised by Worksop Town Academy. These fixtures will take place on Saturdays either

home or away. There will be a minimum of x10 tournaments per season played at home

(4.1.d.ii) For U13 & U14: these will be entered into the Junior Premier League programme.

These fixtures will take place on Saturdays either home or away.

(4.1.d.iii) For U15-U17: these will be entered into the Notts Youth Football League. These

fixtures will take place on Saturdays either home or away.

(4.1.d.iv) For U7: players of this age group will not be entered into a specific games

programme, with the focus being primarily on development. However, U7 players

may be asked to step up and represent a higher age group if all parties are in

agreement.

(4.1.d.v) Venues: “Home” venues may either be at Worksop Town FC (full address in 1.6)

or at Worksop College, Cuthbert’s Avenue, S80 3AP.

(4.1.d.vi) Wherever possible parents & guardians should advise Worksop Town Academy

staff of their player’s attendance at training sessions and games no later than 48

hours prior. Worksop Town Academy appreciates that this is not always possible

however the support of parents to assist coaching staff in the planning &

preparation of their delivery is much appreciated.

4.1.e) Provide all training equipment & facilities for football session delivery

4.1.f) Provide a pre-season camp, which runs Monday to Friday 9:00am-1:00pm, and is

scheduled for the week commencing 21st-23rd August 2023

4.1.g) Communicate all information quickly & effectively to all academy players & parents of

events outside of the weekly schedule as well as any postponed or cancelled training sessions

or fixtures. Such communication would be via email and/or via a communication app.

4.2 We reserve the right to amend or change the training or games schedules and notice will be given

via communication as soon as possible as outlined in 4.1.g above. Parents should understand that due

to the nature of football that sometimes fixtures/events may change at short notice.

5. PLAYER KIT

5.1 By agreeing to these terms you agree to purchase Worksop Town Academy Players Kit, as a

minimum this will be a playing shirt and a training shirt along with black shorts & socks.

5.2 Worksop Town Academy kit will be purchased via a third party, and we accept no responsibility

for any issues with Player kit such as delays or stock issues.

5.3 All Worksop Town Academy players must understand that by wearing club kit they are

representing the club whether on or off the pitch. Any reports of poor behaviour whilst wearing

Worksop Town Academy attire in the community will result in disciplinary action as deemed

appropriate by the Academy Director

6. ENDING THE CONTRACT

6.1 Your rights to end the contract. Where you have a good reason for ending the contract. You may

end the contract between us by giving us no less than 30 days' written notice at any time, such notice to

expire on the last day of the following month (including during the Initial Fixed Term or a Subsequent

Fixed Term) if:

6.1.a) we tell you that we are making a permanent material change to the facilities or the location

of the premises under clause 9.1 and you reasonably consider that the change is materially

detrimental to you.

6.1.b) we tell you that we are changing these terms and you reasonably consider that the

change is detrimental to you

6.1.c) we tell you that we are changing your fees under clause 3.6 and you don't want to pay the

increased fee

6.1.d) your financial situation becomes significantly worse than it was at your Joining Date, so

continuing to pay your fees is unaffordable for you. In this case you must be able to provide to us

reasonable evidence of this.

6.1.e) you permanently move away from the area in which the Premises is based, such

that travelling to training would take longer than 90 minutes, and you can provide

reasonable evidence of this to us.

6.1.f) if a player suffers an injury or illness which prevents them from being able to participate in

training for the forseeable future or the duration of the remainder of the Season. Evidence of this

must be provided in writing by a doctor or other medical professional.

6.1.g) if a player that has previously frozen their contract due to being selected to trial for an EFL

or Premier League club, as per clause 7.2.b, and has been accepted by the EFL or Premier

League Club on a permanent basis or for the remainder of the Season. Termination of contract

for this reason will only be permitted if the steps outlined in clause 7.2.b have been followed prior

to this.

6.1.h) Where you have another good reason for ending the contract at the discretion of

Worksop Town Academy and agreed by both parties in writing.

6.2 You can cancel your membership within 14 days of your Joining Date (referred to as the "cooling

off period") without giving a reason. If you want to exercise this right to cancel, please let us know in

the following way: by emailing us at enquiries@worksoptownacademy.co.uk

6.3 If you cancel during the cooling off period as outlined in 6.2 above, we will refund your fee

pro-rata from the date you write to us.

6.4 If you are not ending the contract for one of the reasons set out in clauses 6.1, your contract will

end 30 days after you give us notice in writing of your intention to end the contract. In that case, we will

charge you a termination fee. The termination fee will not be any more than your membership fees for

the remainder of your Initial Fixed Term, and less any costs we save and the benefit to us in receiving

payment early.

7. FREEZING YOUR CONTRACT

7.1 Freezing of your contract will only be permitted in exceptional circumstances outlined in the clauses

in 7.2 below. Freezing your contract would take place effective from the date you informed Worksop

Town Academy. Any training sessions and fixtures remaining in that month from the date you informed

us will be deducted from your fees once the contract is unfrozen, pro-rata from the date your fees were

frozen. If the contract is never unfrozen, and instead terminated as per clause 6, no refund will be

given.

7.2 Reasons for freezing your contract;

7.2.a) if a player is temporarily unable to train for a period of 3 weeks or more due to injury or

illness, the contract may be frozen for a period of 1 month, so long as written evidence of this

has been provided by a doctor or other medical professional. Should the player still be unable to

train due to injury or illness in subsequent months, written evidence by a doctor or other medical

professional must be provided, and with an expected duration of absence from such physical

activity. Any injury or illness that is expected to prevent the player from training for longer than 2

consecutive months, as per clause 7.5, will be reviewed on a case by case basis and at the

discretion of Worksop Town Academy.

7.2.b) if a player has been selected to trial for an EFL or Premier League club, the contract

between us may be put on hold for the duration of their 8 week trial. Evidence of this trial must

be provided by way of a signed YD-8 form from the club stating their intention to take the player

on trial. If this trial results in a signing by the EFL or Premier League Club, then the policy

outlined in clause 6.1.h will apply.

7.2.b) Where you have another good reason for temporarily freezing the contract at the

discretion of Worksop Town Academy, usually with reasonable written evidence for the

reason, and agreed by both parties in writing.

7.3 Holidays are not a permitted reason for freezing your contract.

7.4 Personal financial circumstances are not a permitted reason for freezing your contract. In this

circumstance the contact might be eligible for termination under clause 6.1.e above.

7.5 Freezing of contacts will only be permitted for a duration of 2 consecutive months. Thereafter the

contract will either (i) be reinstated and fees will continue to be paid once again on the 1st of the 3rd

month after the initial freezing, (ii) the contract terminated under one of the clauses listed in 6.1 above.

In the case of subsequent termination, any missed training sessions/fixtures that were remaining in the

first month of your notice of freezing will not be refunded.

7.6 A maximum of two instances of freezing of a contract will be permitted in any one season.

8. CODES OF CONDUCT

8.1 General rules of conduct. You agree that you will, and (if relevant) any guests that accompany you

onto the premises will:

8.1.a) show consideration for other members, their guests and all staff at the premises

8.1.b) not use inappropriate, abusive, offensive or foul language

8.1.c) not behave in a way that is inappropriate, violent, offensive or threatening to any other

member, their guests or the staff on the premises

8.1.d) not bring, use or be under the influence of illegal drugs in any part of the premises

8.2.e) not be drunk in or about the premises

8.3.f) not behave in an anti-social or disruptive manner, including but not limited to, inappropriate

or threatening behaviour, misuse of equipment or sexual or illegal activities

8.2 Parent’s code of conduct:

Good conduct not only prevents incidents and allegations but also helps to highlight any conduct that is

unsafe or may bring the club into disrepute. Those associating themselves with Worksop Town

Academy should:

8.2.a) Be professional and maintain the highest standards of behaviour at all times towards your

child, other academy players, coaching & management staff as well as match officials and

opposition players & staff - aggressive behaviour and language, including swearing, will not be

tolerated in any circumstance

8.2.b) Recognise the trust placed in you by your child to help support their development and to

support Worksop Town Academy in creating a safe, fun and developmental learning

environment for such development to take place

8.2.c) Understand that if your child develops a behavior-related problem that repeatedly disrupts

practice and/or games, it is your responsibility as the Parent to work with the coach to resolve

the problem

8.2.c) Do your very best to make football fun for your child and his teammates and understand

that your actions and behaviors play a part in such enjoyment

8.2.d) Not confuse the player by giving instruction during training or fixtures

8.2.e) Be supportive of the Worksop Town Academy programme and ensure that any

communication is constructive and delivered via the appropriate channels (i.e. via email at

enquiries@worksoptownacademy.co.uk). As a member of the Worksop Town Academy

community you understand that how, what and where I communicate should not bring the

programme into disrepute both physically and online

8.2.f) Represent the football club and its community in a positive manner both in person and

online. No feedback or concerns will be aired publicly by any parent or guardian via any

academy communication platform including online communication apps, and all social media

channels. If support is required then this is done so via the club email account; FAO Academy

8.3 Player’s code of conduct:

The Player agrees to;

8.3.a) work hard towards attaining your personal goals and those of the team

8.3.b) be a team player and contribute to the building of a positive team

environment

8.3.c) cooperate with and respect your teammates and coaches

8.3.d) attend and participate in all possible training sessions

8.3.e) arrive on time to all sessions and games – if you can’t be on time, inform staff as soon as

possible

8.3.f) give staff as much notice as possible if you cannot make a session for any reason

8.3.g) understand that as a team, we all are expected to respect all match officials, coaches and

fellow competitors. Our manners, conduct and language directly reflect our team mates, coaches

and Worksop Town FC. We all need to behave in a way that makes us proud as a unit.

8.3.h) adhere to the Worksop Town FC site rules & regulations at all times

8.3.i) adhere to all CV-19 guidelines at all times

9. OUR RIGHTS TO TERMINATE AND/OR MAKE CHANGES TO THIS CONTRACT

9.1 Any actions, conducted by parents, player, carer or guest, which breach the codes of conduct

outlined in 8.1-8.3 above may result in the player’s immediate release from the Academy and ending of

the contract. In this instance, no refund for the remaining sessions/fixtures in that month will be

applicable.

9.2 If the premises closes or becomes unusable in circumstances we did not plan or foresee (for

example if there is extensive damage to the premises or the area around it), we can end the contract

immediately by giving you notice. If we decide to close due to business or operational reasons, we can

end the contract by giving you at least 30 days' notice in writing.

9.3 We may make changes to the service we provide or to the terms of the contract, including fees, for

any of the following reasons;

9.3.a) we may change, remove, or improve or add to our service at our discretion as this ensures

we respond to customer needs and remain competitive

9.3.b) the cost to us of providing the facilities or other costs associated with running our business

increase (for example, we have to pay third parties more to provide services or goods to us)

9.3.c) to introduce new charges where the cost of running our business increases

9.3.d) we reorganise the way we structure or run our business

9.3.e) other valid legal or regulatory reasons

9.4. Other reasons for changes. We are provided access to the facilities of Worksop Town FC on an

ongoing basis and we cannot foresee what may change in the future. This means we may need to

make changes for reasons other than those set out above.

10. TIMETABLE

10.1 Training sessions will take place as detailed in the timetable below. Though there are

no scheduled changes in the foreseeable future, we reserve the right to amend this at any

time.

10.2 If permanent changes are made to the timetable, and you do not wish to continue your

contract with us due to this, termination of the contract may occur as per clause 6.

11. EXCLUSION OF LIABILITY

11.1 Except in the case of fraud Worksop Town Academy, its coaches, servants, employees or agents

accept no responsibility under any circumstances for any loss (consequential or otherwise), damage,

expense or delay suffered or incurred by the Parent, the Player or any other party arising directly or

indirectly or in any way connected with the attendance of the Player at the Season (or any part of it) or

any other act or omission on the part of Worksop Town Academy Academy or agents even if such act

or omission is negligent.

11.2 The Parent agrees (for and on behalf of the Parent and the Player) that any claim by the Parent

or the Player against Worksop Town Academy or any coach, employee or agent of Worksop Town

Academy must be brought within 60 days of the event that gave rise to such claim made thereafter

shall be time-barred.

11.3 The Parent acknowledges, warrants and undertakes (for and on behalf of the Parent and the

Player) that the maximum aggregate liability of Worksop Town Academy to the Parent and/or

Player under these terms shall not exceed the Fee.

11.4 All warranties and conditions whether implied by statute or otherwise are excluded from this

contract provided that nothing in this contract shall restrict or exclude liability for death or

personal injury caused by the negligence of Worksop Town Academy, its coaches, servants,

employees or agents or affects the statutory rights of the parent or pupil.

13. GENERAL

13.1 These Terms constitute the entire agreement between the parties hereto and supersede all

prior agreements and understandings between the parties. It is agreed that no statement, promise or

inducement whether written or oral alleged to have been made by either party and which is not

contained herein shall be binding or form part of this agreement.

13.2 This entire agreement shall be governed by English Law and shall fall under English jurisdiction.
